Site-ul web TCIApartments.ro, denumit în continuare „Site-ul web”, este proprietatea TCI SOCIAL CLUB S.A., cu sediul central în România, Cluj-Napoca, strada Alexandru Vaida Voivod nr. 2, înregistrată la Registrul Comerțului din Cluj-Napoca sub numărul J12/3255/2023, cu număr de TVA RO48557430. TCI Contractor General, denumit în continuare „TCI”, este operatorul de date cu caracter personal transmise și prelucrate prin accesarea Site-ului web sau în cazul participării la o campanie promoțională, o procedură de premiere sau un eveniment organizat de noi.

Prelucrăm datele cu caracter personal furnizate de dumneavoastră, denumit în continuare „Utilizator” sau „Dumneavoastră”, în conformitate cu Regulamentul (UE) 2016/679 al Parlamentului European și al Consiliului din 27 aprilie 2016 privind protecția persoanelor fizice în ceea ce privește prelucrarea datelor cu caracter personal și privind libera circulație a acestor date și de abrogare a Directivei 95/46/CE (Regulamentul general privind protecția datelor).

Prin acceptarea bannerului de cookie-uri din pagina principală a site-ului nostru web, înseamnă că ați luat la cunoștință conținutul Politicii de confidențialitate și, în același timp, vă dați consimțământul pentru prelucrarea datelor cu caracter personal conform specificațiilor de mai jos.

Această Notificare privind confidențialitatea („Informații”) se aplică TCI SOCIAL CLUB S.A. și tuturor sediilor sale secundare, inclusiv TCI APARTMENTS (denumită în continuare „TCI” sau „noi”). TCI depune toate eforturile pentru a vă oferi produse, servicii și experiențe la cel mai înalt nivel. Ne bucurăm că sunteți clientul nostru și vă apreciem loialitatea. Suntem conștienți că confidențialitatea este o problemă importantă pentru fiecare client. Prin intermediul acestor Informații, vă explicăm practicile noastre privind datele cu caracter personal pe care le colectăm fie prin intermediul acestui site web, fie prin aplicațiile/formularele noastre, prin comunicări scrise sau orale cu noi, atunci când vizitați una dintre proprietățile noastre sau din alte surse.

Vă rugăm să rețineți că aceste informații nu sunt valabile pentru prelucrarea de către noi în numele anumitor părți și conform instrucțiunilor necesare ale acestora, cum ar fi clienți corporativi (angajatori), operatori turistici și agenți de turism.

Definiții:

„Date cu caracter personal” - înseamnă orice informație referitoare la o persoană fizică identificată sau identificabilă („persoană vizată”); o persoană fizică identificabilă este o persoană care poate fi identificată, direct sau indirect, în special prin referire la un identificator, cum ar fi un nume, un număr de identificare, date de localizare, un identificator online sau la unul sau mai mulți factori specifici identității fizice, fiziologice, genetice, psihice, economice, culturale sau sociale a acelei persoane fizice;

Sunt interzise „categoriile speciale de date cu caracter personal” care dezvăluie originea rasială sau etnică, opiniile politice, convingerile religioase sau filozofice sau apartenența sindicală, precum și prelucrarea datelor genetice, a datelor biometrice în scopul identificării unice a unei persoane fizice, a datelor privind sănătatea sau a datelor privind viața sexuală sau orientarea sexuală a unei persoane fizice.

„Prelucrarea datelor cu caracter personal” (Prelucrare) înseamnă orice operațiune sau set de operațiuni efectuate asupra datelor cu caracter personal sau asupra seturilor de date cu caracter personal, cu sau fără mijloace automate, cum ar fi colectarea, înregistrarea, organizarea, structurarea, stocarea, adaptarea sau modificarea, extragerea, consultarea, utilizarea, divulgarea prin transmitere, diseminarea sau punerea la dispoziție în orice alt mod, alinierea sau combinarea, restricționarea, ștergerea sau distrugerea;

„Operator”  înseamnă persoana fizică sau juridică, autoritatea publică, agenția sau alt organism care, singur sau împreună cu altele, stabilește scopurile și mijloacele de prelucrare a datelor cu caracter personal; în cazul în care scopurile și mijloacele unei astfel de prelucrări sunt stabilite de dreptul Uniunii sau de dreptul statului membru, operatorul sau criteriile specifice pentru desemnarea acestuia pot fi prevăzute de dreptul Uniunii sau de dreptul statului membru;

”Persoană împuternicită de operator” înseamnă o persoană fizică sau juridică, o autoritate publică, o agenție sau un alt organism care prelucrează date cu caracter personal în numele operatorului;

”Terț” înseamnă o persoană fizică sau juridică, o autoritate publică, un agenție sau un organism, altul decât persoana vizată, operatorul, persoana împuternicită de operator și persoanele care, sub autoritatea directă a operatorului sau a persoanei împuternicite de operator, sunt autorizate să prelucreze date cu caracter personal;

„Consimțământul” persoanei vizate înseamnă orice indicație liberă, specifică, informată și lipsită de ambiguitate a dorinței persoanei vizate, prin care aceasta, printr-o declarație sau printr-o acțiune afirmativă clară, își dă acordul pentru prelucrarea datelor cu caracter personal care o privesc;

„Pseudonimizare” înseamnă prelucrarea datelor cu caracter personal într-un mod care să nu mai poată fi atribuite unei anumite persoane vizate fără utilizarea unor informații suplimentare, cu condiția ca aceste informații suplimentare să fie păstrate separat și să facă obiectul unor măsuri tehnice și organizatorice care să garanteze că datele cu caracter personal nu sunt atribuite unei persoane fizice identificate sau identificabile;

ANSPDCP - înseamnă autoritatea publică independentă de supraveghere din România, respectiv Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal

Este posibil să colectăm date cu caracter personal la fiecare întâlnire sau interacțiune cu oaspeții, precum și în cadrul celorlalte aspecte ale activității noastre. Aceste informații personale pot include:

• Datele prelucrate sunt cele pe care le-ați furnizat, și anume:
• Nume, prenume, adresă de e-mail, număr de telefon și adresă de domiciliu;
• detalii despre cardul de credit (numărul de credit, titularul cardului, data expirării și CVV);
• caracteristici personale, naționalitate, numărul pașaportului și data și locul emiterii;
• informații despre vehiculele pe care le puteți aduce pe proprietatea noastră

Personal information:

Data collected automatically:

While surfing the website, the following information can be collected, which is stored in the website’s server log file:

• IP address;
• type of browser;
• the parameters of the device used to connect to the website;
• ISP name;
• visit time and date;
• referral and exit page;

These data are collected to examine users’ trends and gather aggregate information, manage and ensure website safety, and cannot reveal the user’s identity.

In addition, we collect other personal information, in certain situations, such as:

• On-site collection: We collect additional personal information during registration / accommodation on our properties, including information that may be required by law. We can also use video cameras or closed circuit television and other security measures at our properties that can capture or record images of guests and visitors in public area.
• Social media: If you access the TCI pages / accounts through social media, we may collect certain information from your social account based on the social network settings, such as (but not limited to) location, accommodations, activities, interests, photos, status updates and friends list. We can also allow you to sign up for contests where you must provide photos, such as photos of the stay spent on our property, which you can share with the people you are connected to on social networks for votes, common offers or other promotions.

PERSONAL INFORMATION WE COLLECT FROM THIRD PARTIES

It is possible to collect information about you from third parties, such as the services related to social networks that are in accordance with the settings made by you for these services and from other third-party sources that are authorized to transmit your data to us (such as real estate agents, tourism agencies or tour operators). We use and distribute this information (and we may add this information to other information we hold about you) for the purposes described in this Information.

PURPOSE OF PERSONAL DATA COLLECTION

We use your personal information for different purposes, including to provide and customize the services you request and expect from TCI, to provide the expected level of hospitality on our property and to perform direct marketing and promotional actions, as well as shown below:

• to perform services or operations agreed upon in the contract (e.g. manage your online booking, provide you with customer care etc.);
• to meet fiscal obligations;
• to make contact with you, to deal with the requests you made through online forms;
• to comply with legal obligations and regulations, either national or European ones, or to carry out orders from judicial authorities and monitoring bodies;
• for the establishment, exercise or defence of legal claims in court proceedings, to pursue the legitimate interest of the data controller concerned;

• with your consent, to promote new products, services or offers that interest you, by means of advertising, informative, promotional or new material; to carry out market surveys, economic and statistical analyses; to encourage third parties to send advertising, informative and promotional material concerning their own products and services;
• improvement of services: we can use your personal information to improve TCI services and to ensure that our website, our products and services are of interest to you. We use your personal information to provide the expected level of hospitality on our property;

HOW ARE YOUR DATA USED

The processing of your personal data is done through the stages indicated in Article 4, n. 2) of GDPR, viz.: collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. Collection is both paper-based and electronically-based, and includes measures aimed at ensuring the security and confidentiality of your data.

PERSONAL INFORMATION WE TRANSFER

The controller can communicate your data without your consent to perform service purposes:

• to judicial authorities, upon their request;
• by staff authorised by TCI;
• by commercial partners and service providers that work on behalf of TCI, being them responsible of external processing and performing activities which are connected, related or supplementing those of the controller;
• to all those to whom it is necessary to communicate them, either for law or by contract, to enable the performance of the purposes described above (e.g. credit bodies, professional firms, commercial partners);

• business transactions: as we grow our business, we can sell, buy, restructure or reorganize business or capital, or we can stop managing or holding a hotel that is part of our portfolio at the present time. In such circumstances, TCI may transfer, sell or transfer the collected information, including, without limitation, other information (described below) and personal data to one or more third parties affiliated or unrelated in connection with these commercial transactions. To the extent required by law, we will provide a notification of our intention to transfer personal data to third parties for this purpose and explain how you may refuse such transfer.

Other: in addition, TCI may disclose personal information for:

• comply with the applicable laws,
• respond to requests from government or public authorities,
• protect the rights, confidentiality, security or property of TCI, website visitors, customers, employees or the public,
• allow us to find available remedies or limit the damages we can sustain,
• to apply the terms and conditions of our sites and

If your data might be transferred outside the European Union, in order to protect your data in the context of these transfers, the controller takes specific measures, among other the consent of the data subject, the decision of adequacy and the standard contractual clauses adopted by the European Commission.

When you visit or interact with the website, www.tciapartmets.ro, we collect other information that will not identify you directly regarding the use of the website, such as a catalog of the websites you visit and the number of our site visits. We use “Other information”, as well as data received from third parties, to send you emails and advertisements online (on our sites and on other sites) and on mobile.

We use cookies and other technologies (such as “pixel tags”, “web beacons”, “transparent GIFs”, links in emails, JavaScript, device IDs assigned by Google, Facebook, Apple or technologies (similar) to collect this information. PERSONAL INFORMATION ABOUT CHILDREN

We do not knowingly collect personal information about persons under 18 years old. As a parent or guardian, please do not allow children to transmit personal data without your permission.

THE LEGAL TERMS OF THE PROCESSING

We have several legal grounds for collecting the information we have you already informed:

• In order to be able to accommodate you, we collect the information from the accommodation and send them to the authorities on the basis of a legal obligation. Refusal to provide this information leads to the impossibility of providing your service;
• To be able to offer you the services for which you pay, including through the third parties we work with, as well as to collect the actual payment, the basis of the processing is the execution of the contract with you. Refusal to provide this information leads the impossibility of providing your service or, as the case may be, of not being able to accept a certain method of payment or of offering the services to a certain third party;
• To send you marketing communications - including by your active participation with us on social networks, the basis is our legitimate interest, respectively your consent, which you can withdraw at any time through the unsubscribe function to the messages received or through any another way you want to ask us to stop communicating with you; the withdrawal of the consent will not affect the legality of the processing carried out on the basis of the consent before its withdrawal.
• For the other purposes mentioned in the present information, we base our legal interest to keep a record, to improve our services and to coordinate our activity and the third parties with whom we collaborate in providing these services. To the extent that a certain processing described in this information is found to be disproportionate to the situation you are in, please let us know immediately and we will analyze your request, and will send you a detailed response.

PROTECTION OF PERSONAL DATA

TCI will take all reasonable measures to:

• protect personal information from unauthorized access, disclosure or destruction
• keep personal information accurate and updated as appropriate.

We also ask our affiliates and service providers with whom we share personal information to make reasonable efforts to maintain the confidentiality of personal information about you. For online transactions, we use reasonable technological measures to protect the personal information you transmit to us through our website. However, unfortunately, no security system or data transmission system on the Internet can guarantee the security of your data. For the protection of your private life, we recommend that you do not send us credit card numbers or any other confidential personal information by e-mail. We will not contact you via mobile / text messages or emails to request confidential information or credit card details. We will only ask for your credit card details by phone when making a reservation.

MODIFYING AND ACCESSING YOUR PERSONAL DATA

Data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information:·       To access your data: You have the right to access your data to know which of the personal data we process and the conditions under which are processed.·       To request the rectification or deletion of your data: In certain circumstances, you have the right to rectify the personal data that you consider to be inaccurate and concerning you, which are subject to processing by the Company, as well as the right to request the deletion of data, when, among other reasons, the data is no longer needed for the purposes for which it was collected·

To request the restriction of the processing of your data: In certain circumstances, you have the right to request the restriction of the processing of your data, in which case we inform you that we will keep the data in relation to which you have requested the restriction of the processing only for the exercise or defense of a legal right.· On the portability of your data: In certain circumstances, you will have the right to receive the personal data that concerns you, and which you have provided to us, in a structured format that is currently used and can be read automatically, as well as to be transmitted by the Company to another operator.·

To disagree the processing of your data: In certain circumstances and for reasons related to your particular situation, you have the right to oppose the processing of your data, in which case the processing will cease, unless we have to continue to do so for compelling legitimate reasons or for the exercise or defense of a legal right.· Not to be the subject of a decision based solely on automated processing, including the creation of profiles, which produces legal effects that affect the data subject or affect him in a similar way in a significant way. We also remind you that you have the right to withdraw any consent you have provided for the processing of your data, without this affecting the legality of the processing based on the consent before it is withdrawn.

TCI has the right, under the legal provisions, to request additional information necessary to confirm the identity of the data subject, in case he has any doubts about the identity of the requesting person. TCI will provide the requested information within maximum one month from the receipt of the request. This period can be extended by a further two months if necessary, depending on the complexity of the applications and their number.

TCI informs that you can fill a complaint at the Data Protection Authority (ANSPDCP) in Romania. However, we encourage you to forward your complaint to the data protection officer in the first instance, to be resolved amicably.

STORAGE OF PERSONAL DATA

We keep your personal data for the period necessary to achieve the purposes explained in this Information, if a longer period of storage time is not required or permitted by the applicable law. We will destroy your personal information as soon as possible in a way that it can no longer be recovered or reconstituted. If personal information is printed on paper, will be destroyed in a secure manner by chipping or burning documents on paper or otherwise, and if are saved on electronic media, they will be destroyed by technical means to ensure that information can no longer be retrieved or reconstituted later.

MARKETING COMMUNICATIONS

If you have provided us your contact information (postal address, fax number, e-mail address or telephone number), we may inform you, depending on your preferences and with your agreement in the necessary cases, about our products and services or invite you to events via email, online advertising, social networks, telephone, text messages (including SMS and MMS). If you prefer not to receive advertising material by e-mail, you can unsubscribe using the unsubscribe function from the e-mail you receive from us. Unsubscribe requests may take up to ten business days to take effect. To unsubscribe from the text messages, communicate to our email [email protected] the fact that you no longer want to receive text messages from our hotel or reply to the message with the text “STOP”.

MODIFICATIONS OF THE INFORMATION

It is possible to make changes to this Information periodically. If we make significant changes to this Information, we will publish a link to the Revised Information on the home page of our website, and if you have registered for any of our products or services, we will inform you through a communication channel. You can find the date of the last update of the Information, by consulting the link and the date from the beginning of the Information. Any change of this Information will come into effect when the revised Information is published on the site.

Cookie-uri

Site-ul folosește doar cookie-uri strict necesare, care nu necesită acordul prealabil al vizitatorului (art. 4 alin. (5) lit. b) din Legea nr. 506/2004):

• pll_language - reține limba aleasă (română sau engleză), valabil 1 an;
• cc_cookie - reține că ați citit informarea despre cookie-uri, valabil 6 luni;
• cookie-uri tehnice de securitate setate de Cloudflare (de ex. __cf_bm), rețeaua prin care este livrat site-ul, pentru protecția împotriva traficului automat.

Nu folosim cookie-uri de publicitate sau de analiză și nu urmărim vizitatorii în scopuri statistice. Puteți bloca sau șterge cookie-urile oricând din setările browserului.

Protecția formularului de contact (Cloudflare Turnstile)

Pentru a împiedica trimiterea automată de mesaje nesolicitate (spam), formularul de contact folosește serviciul Cloudflare Turnstile, furnizat de Cloudflare, Inc. La afișarea și trimiterea formularului, Cloudflare prelucrează date tehnice (de exemplu adresa IP, tipul browserului și semnale despre interacțiunea cu pagina) exclusiv pentru a verifica faptul că mesajul este trimis de o persoană. Temeiul prelucrării este interesul nostru legitim de a proteja site-ul împotriva abuzurilor (art. 6 alin. (1) lit. f) din GDPR). Detalii în politica de confidențialitate Cloudflare Turnstile.

Tot pentru a preveni abuzurile, limităm numărul de mesaje care pot fi trimise într-un interval de timp. În acest scop păstrăm temporar, cel mult 24 de ore, doar o amprentă criptografică (hash) a adresei IP, din care adresa nu poate fi reconstituită.

Conținut de la terți

Unele pagini afișează conținut găzduit de alți furnizori: harta Google Maps (pagina principală, Contact și Locație), videoclipuri YouTube (Vizitează Cluj-Napoca) și fonturile Google Fonts. La afișarea acestui conținut, furnizorii (Google) primesc adresa IP a vizitatorului și pot seta propriile cookie-uri, conform politicilor proprii. Rezervările online se fac pe platforma externă Pynbooking, care are propria politică de confidențialitate.
